NEW DELHI: The Supreme Court on Monday said the plea challenging mandatory linking of Aadhaar with services like bank accounts and mobile numbers would be decided by a constitution bench which would take up the case after concluding the hearing on the dispute between the Delhi government and the Centre over jurisdiction over the national capital.

A bench headed by Chief Justice Dipak Misra, before whom the petitioners sought an early hearing, asked them to mention the case after the Delhi matter was over. Senior advocate Shyam Divan, appearing for one of the petitioners, said the case needed to be heard at least for an interim order as the Centre had made it mandatory to link Aadhaar with bank accounts and mobile connections in addition to social welfare schemes.

Attorney general K K Venugopal, appearing for the Centre, opposed the plea and said an interim order could not be passed in a matter of “national importance”.

“Even an interlocutory order can only be passed by the constitution bench,” the top court said and asked the lawyers to mention the matters once the five-judge bench concluded hearing on appeals of Delhi government challenging a high court order that the lieutenant governor was the administrative head of the capital.

On October 30, the apex court had said a constitution bench would start hearing the clutch of petitions against Aadhaar from the last week of November. But the matter could not be taken up as the constitution bench is busy hearing the legal dispute over Delhi’s jurisdiction.
